elementor - v3.18.0 - 20-12-2023 *\/\n.elementor-widget-text-editor.elementor-drop-cap-view-stacked .elementor-drop-cap{background-color:#69727d;color:#fff}.elementor-widget-text-editor.elementor-drop-cap-view-framed .elementor-drop-cap{color:#69727d;border:3px solid;background-color:transparent}.elementor-widget-text-editor:not(.elementor-drop-cap-view-default) .elementor-drop-cap{margin-top:8px}.elementor-widget-text-editor:not(.elementor-drop-cap-view-default) .elementor-drop-cap-letter{width:1em;height:1em}.elementor-widget-text-editor .elementor-drop-cap{float:left;text-align:center;line-height:1;font-size:50px}.elementor-widget-text-editor .elementor-drop-cap-letter{display:inline-block}<\/style>\t\t\t\t<p>Come noto, qualora l\u2019interessato risieda in Italia \u00e8 prevista la possibilit\u00e0 di instaurare la procedura di riconoscimento del possesso della cittadinanza italiana <em>iure sanguinis<\/em> presso il Comune di residenza con apposita istanza indirizzata al Sindaco.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ee81c38 elementor-widget elementor-widget-text-editor\" data-id=\"ee81c38\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Pertanto, com\u2019\u00e8 ovvio, anche in questo caso il richiedente dovr\u00e0 preventivamente essere in possesso dell\u2019intera documentazione attestante la discendenza da avo italiano la quale, allegata alla domanda, sar\u00e0 sottoposta alla valutazione dell\u2019ufficiale di stato civile del Comune di residenza.<\/p><p>Il deposito dell\u2019istanza presso l\u2019ufficio comunale rappresenta pertanto l\u2019avvio del procedimento al quale seguir\u00e0 una fase istruttoria e si concluder\u00e0 con l\u2019emanazione di un provvedimento finale.<\/p><p>Il termine per l\u2019espletamento della procedura, secondo il principio generale di cui all\u2019art. 2 comma 4 L. 241\/1990 per i procedimenti particolarmente complessi, \u00e8 individuato in <strong>180 giorni<\/strong>. <u>Non si ritengono pertanto giustificati da nessuna norma termini superiori come definito da alcuni Comuni a mezzo di appositi regolamenti. \u00a0<\/u><\/p><p>Se per qualsiasi ragione vi \u00e8 il rigetto della domanda, \u00e8 sempre possibile la presentazione di una successiva una volta in possesso della documentazione dirimente la problematica di cui al primo rigetto.<\/p><p>Viceversa, in presenza di tutti i requisiti di legge, il procedimento si concluder\u00e0 con l\u2019accoglimento dell\u2019istanza con provvedimento che riconoscer\u00e0 che il richiedente (ed eventuali figli minori) \u00e8 cittadino italiano sin dalla nascita e provveder\u00e0 alle trascrizioni e ulteriori comunicazioni.<\/p><p><u>A questo proposito si raccomanda di prestare molta attenzione poich\u00e9 si registra la prassi da parte di alcuni Comuni di non restituire i documenti originali allegati alla domanda, indipendentemente dall\u2019esito del procedimento, trattenendoli nei propri archivi per ragioni legate alla procedura di protocollazione degli atti.<\/u><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Pratica Presso Il Comune di Residenza Come noto, qualora l\u2019interessato risieda in Italia \u00e8 prevista la possibilit\u00e0 di instaurare la procedura di riconoscimento del possesso della cittadinanza italiana iure sanguinis presso il Comune di residenza con apposita istanza indirizzata al Sindaco.
